Chief Magistrate Francis Andayi withdrew himself from Babu Owino’s attempted murder case on Monday over the controversial bail term he had granted him.
The Magistrate had granted Owino a cash bail of Sh.10M that was to be payable in four installments. Babu Owino, who is the Embakasi East MP, was arrested after he shot and injured DJ Evolve on January 17. He was released on bail on 29th January 2020 after spending 10 days in custody.
The Director of Public Prosecution (DPP) Noordin Haji contested the bail term granted to the firebrand legislator, which required him to pay bail in installments. The DPP wrote a complaint to the judicial service review over a ruling he had issued, thus prompting Andayi to disqualify himself when the matter came for hearing on Tuesday.
In a Statement seen by Phode News, Andayi ruled that “due to various reasons I will not handle this matter but I will forward it to my colleague Bernard Ochoi.”
